Kippy's on North Park Avenue remained dark and deserted yesterday.
It could not open its doors for business after the Marshall Foundation notified the owner that the right to occupy the space at 831 N. Park Ave. had been terminated.
The Marshall Foundation owns and manages the property in the University Square area along East University Boulevard and Park Avenue. They also own the Geronimoz complex at University and Euclid Avenue.
The foundation taped a letter from their attorney to Kippy's doors and re-keyed the locks, said Sharon Hines, Kippy's owner and president of the Campus Merchants Association.
Ron Mumford, office manager for the Marshall Foundation at 903 E. University Boulevard, only would say that Kippy's was in default of its lease.
Hines said she is working with her attorney to resolve the differences with the foundation.
"As soon as I hear back from my attorney, we'll know what's going on," Hines said in a telephone interview yesterday.
"Hopefully, we'll be back in tomorrow," she said.
Hines and other merchants have said they have been dealing with drops in sales related to the University of Arizona's All Aboard card. In interviews last week, Hines said she was concerned whether Kippy's would be around after Christmas and said the Marshall Foundation had changed the status of her lease from a 15-year lease to a 12-month lease with a 4-month out-clause.
