A UA student who was sexually assaulted in a campus parking garage last spring has filed suit against UA, claiming the garage was unsafe.
The complaint, which was transferred to Pima County Superior Court last week,
stated that the university did not take proper measures to assure safety in the Park Avenue Garage, 1140 N. Park Ave. An unknown man sexually assaulted the student in the garage April 26.
The 22-year-old political science junior's name has been withheld to protect her identity.
A copy of the suit obtained by the Wildcat stated that the UA failed to "properly warn and instruct · about the dangers of assault on and near the university campus."
The complaint also stated that the garage didn't have proper lighting, signage, fencing, video cameras or police patrol, which might have prevented the incident.
The suit demands that the defendants, which also include the state, Arizona Board of Regents and University of Arizona Police Department, compensate her for damages, which include healthcare costs, mental suffering and "loss of enjoyment of life."
The student told police she was getting out of her car on the third floor of the garage when the man grabbed her, pushed her back into the vehicle and sexually assaulted her.
The suit was originally filed in Maricopa County in December.
The victim's attorney, Richard P. Broder, and university spokeswoman Sharon Kha both declined to comment yesterday afternoon.
